Short-term rentals in Tucson, Arizona: a simpler city, with caveats

Tucson has no cap and no residency rule for short-term rentals, but taxes, HOAs and state safeguards still shape how owners should operate.

Tucson is a year-round city more than a resort. Winter brings snowbirds and visitors to Saguaro National Park, the Tucson Gem and Mineral Show fills beds in early February, and University of Arizona events create peaks through the academic year. Medical stays and traveling professionals add mid-length bookings. Summer is the soft season. Rentals range from adobe-style houses in historic barrios to casitas, desert homes in the foothills and condos near the university.

A light local framework

Tucson operates under Arizona's A.R.S. § 9-500.39, which makes short-term rentals a permitted residential use and forbids cities from banning them or capping their number. Tucson has not built a heavy permit regime on top: in practice, owners obtain a city business license and an Arizona transaction privilege tax license, and there is no quota and no owner-residency rule. That makes Tucson one of the simpler large Arizona cities to enter, though you should still confirm with the city's business services whether a registration step has been added before you list.

The statute's safeguards still apply statewide. Every owner must name someone who responds to complaints and emergencies promptly, and a city can impose civil penalties for verified violations; repeated or serious violations can lead to a suspension of up to twelve months. A 2026 legislative push to give cities more power (HB 2429) died in a Senate committee, so nothing new is expected before the next session.

Taxes

Short stays carry state, county and city transaction privilege taxes, plus a city lodging component; the combined burden is noticeably higher than a standard sales tax, so price it in. Airbnb and Vrbo collect on their bookings; direct bookings are your responsibility, with monthly or periodic filings under your own license. Rental properties must also be registered with the Pima County Assessor.

Watch the neighborhood, not only the law

Some foothills and northwest subdivisions have HOAs with minimum stay requirements or registration obligations, and those private rules apply regardless of state preemption. Historic districts may limit exterior changes. In summer, pools and air conditioning are critical: a failure becomes a refund.

Why the emergency contact is the weak point

Of everything the state statute still permits a city to require, the named responder is the obligation most often treated as paperwork and the one that produces penalties. It is not an answering service: the person has to reach the property and resolve a complaint quickly, at night and in August. An owner living out of state who names a relative, or a cleaner who is unreachable at weekends, has satisfied the form and not the duty, and verified violations accumulate towards a suspension. Contract the role properly and keep the contact details current with the city.
