Short-term rentals in Atlantic City and Ocean City, New Jersey
Two neighboring shore towns, two systems: a seasonal certificate of occupancy in Atlantic City, a yearly mercantile license in Ocean City.

AirDNA market averages (markets with at least 150 active listings), atlas updated September 2026, in US dollars. An average across all property sizes, not a promise. Rules status: our summary — read the text and the guide.
Atlantic City and Ocean City sit side by side on the South Jersey coast yet sell very different trips. Atlantic City means casinos, concerts, conventions and the Boardwalk, with weekend demand all year. Ocean City, which bills itself as America's greatest family resort and sells no alcohol, means beach blocks, boardwalk rides and multigenerational summer weeks. Margate, Ventnor, Brigantine and Somers Point share the same bays and beaches. Housing runs from boardwalk condos and duplexes to beach-block homes built for big families.
Atlantic City
The city defines a short-term rental as a residential unit rented for 90 consecutive days or less and requires a seasonal certificate of occupancy before operating. That certificate works as the operating license: an inspection checks code compliance and fixes the maximum occupancy. The city's short-term rental office focuses enforcement on noise, parking (in the driveway, without blocking neighbors) and trash kept in containers. The state's guidance notes that Atlantic City imposes no luxury tax on these rentals.
Ocean City
Ocean City requires a mercantile license for each rental unit, valid from June 1 to May 31, billed together with a municipal tourism assessment. There is no primary-residence requirement. Owners also need the smoke, carbon monoxide and fire extinguisher compliance certificate, and liability insurance. The city introduced a 3% municipal occupancy tax on November 1, 2025; when we checked it applied to hotel and motel stays rather than to marketplace bookings, so confirm the current scope.
State taxes
Platform bookings and professionally managed units carry New Jersey's 6.625% sales tax and the 5% state occupancy fee. Rentals executed through a licensed New Jersey real estate broker, keys handed over at the broker's office, are exempt, and that is still how many Ocean City summer weeks are let.
Our advice
- Match the property to the town: condos and weekend stays in Atlantic City, family-size homes and weekly stays in Ocean City.
- Book inspections before the season starts.
- Read condominium bylaws and the zoning of the block for any minimum stay.

Air shows, boat parades and Lucy the Elephant
Some of the best nights in this pair of towns are tied to a handful of events. Atlantic City's summer air show, a long-standing tradition over the beach and Boardwalk, fills every ocean-view window in town. Ocean City's Night in Venice boat parade in July sends decorated vessels along the bay, and bayfront homes with decks become the most sought-after listings of the season. Down in Margate, Lucy the Elephant, a towering wooden landmark, is on every family's to-do list.
Atlantic City's year-round base is broader than casinos. Boardwalk Hall hosts concerts and sports, Steel Pier has rides, and Gardner's Basin and the Absecon Lighthouse appeal to visitors after something quieter. Stockton University's Atlantic City campus and AtlantiCare's hospital add students' families and medical stays.
Travel and practical details
- Getting here: the Atlantic City Expressway and the Garden State Parkway carry most guests, while NJ Transit's rail line links Atlantic City with Philadelphia.
- Ocean City's Music Pier and boardwalk amusement piers keep families walking: bikes and a beach cart are valued extras.
- Corson's Inlet State Park, at the south end of Ocean City, attracts birders and anglers in the shoulder months.
Our caution: bay-side streets on both islands flood during strong tides and storms, even on sunny days. Keep guests informed, and avoid storing belongings or equipment at ground level in those areas.
