Birmingham still regulates rentals through business licenses and taxes, but a 2026 draft ordinance could cap permits and close single-family zones to investors.

Birmingham's visitors are mostly there for a reason other than sightseeing. UAB, one of the largest academic medical centers in the South, brings patients' families, visiting physicians and researchers for stays of days to months. Conventions at the BJCC, concerts at Protective Stadium, college football, the Magic City Classic and events at Barber Motorsports Park create peaks, and a growing food scene and the Civil Rights District add leisure weekends. Houses and apartments in Southside, Avondale, Highland Park, Lakeview and the downtown lofts, all within reach of the medical campus, serve this mix best.

Birmingham has no ordinance dedicated to short-term rentals yet. What is required now:

A draft ordinance to watch

A draft presented in March 2026 would change the picture substantially: permits, a citywide cap, a lottery when applications exceed it, and no whole-home rentals in single-family zones. As of mid-2026 the City Council had not voted. If it passes in that form, investor rentals in single-family neighborhoods would lose their footing, while apartments and mixed-use districts would keep theirs.

Our advice

Buy for the rule that may come, not only for today's. Condos and apartments in mixed-use or multifamily districts near UAB and downtown are the more resilient choice; a single-family house bought purely as a nightly rental carries regulatory risk. Medical stays suit furnished rentals of 30 days and more, which reduces exposure to both the draft ordinance and short-stay turnover costs.
