Short-term rentals in Lincoln, Nebraska
Lincoln licenses every short-term rental unit, with occupancy caps and a 10% ceiling in multifamily buildings. How it works for owners near campus and beyond.

Lincoln is a capital city and a college town, and on fall Saturdays it is mostly a football town: Husker home games at Memorial Stadium fill the city far beyond its hotel capacity. Legislative sessions, University of Nebraska events, graduations, volleyball and wrestling championships, concerts at Pinnacle Bank Arena and state tournaments keep the rest of the year active. Owners rent homes near campus and in the Near South, Clinton, Havelock and Irvingdale, plus newer houses and townhomes on the south and east sides.
Protected by the state, licensed by the city
Nebraska's statute forbids cities from banning short-term rentals but allows them to regulate for health and safety. Lincoln uses that room fully. It is unlawful to advertise a short-term rental in Lincoln without first obtaining a city license, and the license is:
- issued per rental unit and renewed annually;
- available without owner occupancy: your primary residence is not required, which is why our atlas classes Lincoln as Registration;
- subject to an occupancy cap of two persons per sleeping area, with a maximum of twelve guests;
- limited in multifamily buildings in the R-1 to R-8 districts, where no more than 10% of a building's units may be short-term rentals.
Lincoln treats short-term rentals in residential zones as a conditional use approved administratively rather than through a public hearing. Repeated verified disturbances can put a license at risk.
Taxes
Register with the Nebraska Department of Revenue. Stays carry state and local sales tax, the state lodging tax, the Lancaster County lodging tax and any city occupation tax on lodging. Platforms collect part of this; you handle the rest and all direct bookings.
Game-day discipline
- Set minimum stays and group sizes for home football weekends well ahead.
- Count bedrooms with proper egress: the occupancy cap follows sleeping areas, not sofas.
- In a small apartment building, check the 10% ceiling before buying a unit to rent.
- Keep neighbors informed and complaints rare; the license is annual.
Read the building before the block
Lincoln’s real constraint is often the building rather than the neighbourhood. In multifamily property in the R-1 to R-8 districts, no more than ten per cent of a building’s units may be short-term rentals, so a condominium that looks ideal on paper can already be full whatever the zoning permits. Ask the city how many licences the address holds before making an offer. In a house, the binding figures are the other ones: two persons per sleeping area, twelve guests at most, however much a home game weekend would pay.
Our advice
Lincoln offers legal certainty in exchange for disciplined operation. License before you list, respect the occupancy formula and run game weekends tightly. We study every request and tell you honestly whether and how we can help.
