Short-term rentals on Cape Cod, Massachusetts
On Cape Cod, every rental carries a state certificate, a layered room tax and a town registration, and the septic permit decides how many bedrooms you can sell.

Cape Cod is New England's classic summer: fifteen towns on a hooked peninsula, from Falmouth and Barnstable to Chatham, Wellfleet and Provincetown, with kettle ponds, warm bay beaches and the wilder Atlantic shore of the National Seashore. July and August book up months ahead, June and September are the value months, and the rest of the year leans on weekends, weddings and remote workers. Rentals run from shingled cottages and family homes let by the week to condos and in-town apartments.
State registration and the tax stack
Massachusetts has regulated short-term rentals since July 1, 2019. Each operator obtains a certificate of registration from the Department of Revenue through MassTaxConnect, one per property, unless the unit is rented for 14 days or less in the calendar year. The state room occupancy excise is 5.7%; towns may add a local excise of up to 6% and a community impact fee of up to 3% on professionally managed units. Barnstable County, like Dukes and Nantucket, also carries the 2.75% surcharge for the Cape Cod and Islands Water Protection Fund. Operators need at least $1 million of liability insurance per rental, unless the platform's cover is equal or greater.
Town rules on top
Each town then adds its own layer. Chatham, Dennis and Wellfleet, among others, run short-term rental registration linked to the state certificate, with local fees, safety checklists and posted contact details. Most Cape towns do not require the owner to live on site, but details differ from one town hall to the next, and some condominium and cottage-colony associations restrict or forbid weekly rentals.
Septic and bedrooms
Much of the Cape is on septic systems, and the number of bedrooms a house may advertise is tied to its approved design under the state's Title 5 rules. Selling a fourth bedroom the septic permit does not recognize is a common and expensive mistake.
Our advice
Register with the state first, then with the town, and keep both certificate numbers at hand: platforms and inspectors ask for them. Price June and September carefully, since that is where the year is won or lost, and build cleaning logistics around Saturday changeovers and summer traffic on the bridges. We study every request and tell you honestly whether and how we can help.
Why the septic design, not the floor plan, sets your headline
Owners here usually discover the Title 5 limit at the worst moment, when a booking is already taken for a party the house may not lawfully sleep. The design flow behind the permit was set for a household, not for a peak Saturday with every bed filled and a second sitting of showers, and it is the approved bedroom count rather than the number of rooms with a door that the town works from. Two habits settle it cheaply: read the permit before the listing is written, and keep the approved figure in the same folder as the state certificate, so the town, the platform and your changeover team are all working from one number instead of three.
